This policy covers both the Website and the limited personal data that FulcrumQ collects directly from users of the FulcrumQ Digital platform (see Section 1.3). If you are a candidate whose data is processed through FulcrumQ Digital, your data is controlled by the organization that engaged FulcrumQ — please contact that organization for information about how your data is handled.

1. Information We Collect

1.1 Information You Provide

We collect personal information that you voluntarily provide when you interact with our Website:

Contact / Inquiry Form. When you submit an inquiry through our contact form, we collect your name, email address, phone number, and company name. We use this information to respond to your inquiry.

Blog Subscription. When you subscribe to our blog, we collect your email address. We use this information to send you blog post notifications.

1.2 Information Collected Automatically

When you visit the Website, certain information is collected automatically through cookies and similar tracking technologies:

Usage Data. This includes your device’s IP address, browser type and version, the pages you visit, the time and date of your visit, time spent on pages, unique device identifiers, and other diagnostic data. 1.3 FulcrumQ Digital Product Users

If you are a user of the FulcrumQ Digital platform, your account is provisioned by the organization that contracted with FulcrumQ. We collect your email address for the purpose of authenticating your access to the platform. Lawful basis: performance of a contract (Article 6(1)(b) GDPR) — your account exists because the contracting organization has an agreement with FulcrumQ that includes providing you access.

FulcrumQ does not use product user email addresses for marketing, analytics, or any purpose other than authentication and essential service communications (e.g., password resets, security notifications).

Candidate data processed through FulcrumQ Digital — including resumes, assessment responses, and interview recordings — is uploaded and controlled by the contracting organization, not by FulcrumQ. FulcrumQ processes this data solely as a data processor on behalf of that organization, under a Data Processing Agreement. Candidate data may be shared with sub-processors (including our AI processing partner) strictly for the purpose of generating assessment insights and is not retained beyond the processing period defined in the Data Processing Agreement. If you are a candidate and wish to exercise your data protection rights, please contact the organization that initiated your assessment.

2. Cookies and Tracking Technologies

We use cookies and similar technologies to track activity on our Website and store certain information. We categorize these as follows:

Essential Cookies

These cookies are necessary for the Website to function and cannot be switched off. They include session cookies, authentication cookies, and security cookies. Without these cookies, the services you request cannot be provided.

Non-Essential Cookies

These cookies are used for analytics, visitor tracking, and advertising measurement. Where we do so, we require those entities to handle your information in accordance with this Privacy Policy. We do not share your information with affiliates or subsidiaries for their independent marketing purposes.

For the purposes of the GDPR, FulcrumQ LLC is the Data Controller for personal data collected through this Website and for product user email addresses used for authentication. FulcrumQ LLC acts as a Data Processor on behalf of contracting organizations for candidate data processed through the FulcrumQ Digital platform.

5.3 How to Exercise Your Rights

To exercise any of these rights, contact us at privacy@fulcrumq.com. We will respond to your request within one month. If your request is complex or we receive a high volume of requests, we may extend this period by up to two additional months, in which case we will notify you.

We may ask you to verify your identity before processing your request.

6. Consent Withdrawal

Where we process your personal data based on consent, you have the right to withdraw that consent at any time. Here is how withdrawal works for each consent-based activity:

Blog Notifications. Click the “unsubscribe” link at the bottom of any blog notification email. Your email address will be removed from the distribution list immediately. You will no longer receive blog post notifications.

Non-Essential Cookies. Change your cookie preferences at any time by clicking the cookie settings link in the website. When you withdraw cookie consent, non-essential cookies will be removed and tracking will stop.

Consequences of Withdrawing Consent

  • Withdrawing consent does not affect the lawfulness of any processing carried out before the withdrawal.
  • Withdrawing blog subscription consent means you will stop receiving blog post notifications. It does not affect any other relationship you have with FulcrumQ.
  • Withdrawing cookie consent means we will no longer collect analytics data from your visits. This does not affect the functionality of the Website — all essential features will continue to work.

7. Data Retention

We retain your personal data only for as long as necessary for the purposes described in this policy:

When the retention period expires, we delete or anonymize your personal data. If deletion is not possible (for example, because the data has been stored in backup archives), we will securely isolate the data from any further processing until deletion is possible.

8. Data Transfers

Your information, including personal data, is processed in the United States where FulcrumQ LLC is based. If you are accessing the Website from outside the United States, your information will be transferred to and processed in the United States.

Where required by applicable law (such as the GDPR), we ensure that appropriate safeguards are in place for international transfers of personal data, including Standard Contractual Clauses approved by the European Commission.

9. Data Security

The security of your personal data is important to us. We use commercially reasonable technical and organizational measures to protect your personal data against unauthorized access, alteration, disclosure, or destruction. However, no method of transmission over the Internet or electronic storage is completely secure, and we cannot guarantee absolute security.

  3. Delete or anonymize your personal data within one month (or notify you if an extension is required).
  4. Send you confirmation once deletion is complete.
